2024 Fun Cup Endurance Championship Hire Agreement v4

Motorsport is dangerous and participation may result in severe injury or death.

Please read the following declaration:

  • The paragraphs below set out the terms of your agreement with us and create a legally binding contract.
  • These terms tell you who we are, what we are responsible for, what you are responsible for and how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms or require any changes, please contact us to discuss the terms with us.
  • Paragraph 5 limits our liability to you. It is important that you note carefully the limits on our liability and you should consider whether you need insurance to cover any potential loss you may suffer or claims that may be made against you by third parties.
  • If you are unsure about any part of this agreement, we recommend you seek legal advice.

TERMS

1. INFORMATION ABOUT US AND HOW TO CONTACT US

1.1 We are JPR Motorsport Limited a company registered in England and Wales.
Our company registration number is 04327062 and our registered office is at Blackwood Farm, Leek Old Road, Rudyard, Staffordshire, ST13 8FF. Our registered VAT number is 786838949.

1.3 If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provide to us below.

1.4 "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.

1.5 We refer to us as “JPR” and you as the “hirer” or the “driver” in these terms.

2. PAYMENT OF OUR HIRE CHARGE

2.1 JPR agrees to hire to the hirer, a seat or a complete car as indicated on page 5 which meets the Fun Cup Endurance Championship specifications.

2.2 JPR will provide a mechanic/engineer to look after the car and will be responsible for maintaining, refuelling & repairing the car. A Team Manager and pit wall staff will not be provided unless specifically requested, in which case there will be an additional charge.

2.3 The hirer agrees to pay JPR the hire costs and other charges set out in the price list and booking form below. The hire costs include race entry fee, fuel and all mechanical components for normal wear and tear. If an individual item is not ticked in the booking form but JPR provide that service to the hirer at their request, the hirer shall pay the charges as set out in the price list.

2.4 There will normally be two hours of Fun Cup exclusive testing the day prior to each race event, including a pit garage, which will be included in your hire. Should you require additional testing (general testing) this can be made available at a cost of £385 plus vat per hour of booked time, in addition to any circuit fees, which are the responsibility of the hirer. Should general testing be required, please contact Paul by email at [email protected], at least four full working days prior to the event. Please note that the hourly charge is for booked time and the actual track time may be curtailed due to track stoppages or accidents. Please note the damage waiver shown on page 7 is NOT included for any general testing, if required, this will be charged at £85 plus vat per hour booked with an excess of £2,500 per claim/accident.

2.5 Tyres: One set of new tyres per event/weekend are included, any extra tyres if required will be charged to the drivers. Any teams who require a second set of tyres must give 10 days’ notice.

3. ACCIDENTS AND MECHANICAL FAILURE

3.1 JPR shall ensure that prior to the race the car is maintained and shall meet all applicable pre-race checks.

3.2 However, the hirer/driver needs to understand that the nature of endurance racing may result in problems/faults occurring at any stage (including testing and qualifying) with the car. This may include mechanical failure requiring repairs and part replacement. The car may become damaged through accidents or accidents may cause races to be suspended or cancelled. The car may also need to undergo mechanical adjustments.

3.3 If the car suffers from mechanical failure or accident damage or requires mechanical adjustment during testing, qualifying or the race, JPR’s mechanic/engineer provided to the hirer will make every effort to carry out the necessary repairs so the car can return to the track as quickly as possible. However, in some circumstances it may not be possible to repair the car and it may be necessary to withdraw the car from the race.

3.4 You agree by entering into this agreement that you shall not be entitled to any refund of charges and JPR cannot be held responsible for any losses you incur however arising from:

  • Track stoppages
  • Loss of track time or non-availability of the car caused by accidents, mechanical failure, mechanical adjustments or circumstances beyond JPR’s control, during testing, qualifying, or the race.
4. RESPONSIBILITY FOR DAMAGE

4.1 JPR shall be responsible for the cost of normal running maintenance of the car and repairs that arise from normal wear and tear.

4.2 The hirer shall be responsible for any damage caused to the car whether of a mechanical nature or to the car’s bodywork (“damage”), even if a third party such as another race competitor is at fault. The hirer/driver will be responsible for all damage. This includes mechanical damage caused through misuse such as:

  • Driving the car whilst overheating (normal running temperature is 90 degrees) or with low oil pressure (minimum 32psi)
  • Over-revving the engine (normal gear change is 6400 rpm). Anything above 7,000 rpm will require the engine to be stripped and checked.
  • Punctures and other tyre/wheel damage.
  • All damage must be paid for in full before the next round.

4.3 Motor racing is a dangerous sport and damage to the car can easily occur. You acknowledge that JPR has given you the opportunity to pay the accident damage waiver fee or take out insurance to cover you against losses arising from damage to the car and the risk that you take to incur personal liability for damage to the car if you are not insured.

4.4 The hirer/driver is responsible for all damage incurred whilst they are driving. If JPR agree to divide the cost of any damage repair or replacement of the car equally between all team members, all team members must agree to this and give written instruction to JPR before the event. In this event, each team member agrees with the hirer to be jointly and severally liable for the cost of damage repair or replacement.

4.5 The hirer/driver has the option of paying an accident damage waiver fee (which can be exclusive or inclusive of fire damage) details of which are given in the booking form and price list below under the heading ACCIDENT DAMAGE WAIVER, (see pages 6 & 7) which will limit the amount payable in the event of accident as stated.

5. LIMITS ON OUR RESPONSIBILITY FOR DAMAGE

5.1 JPR do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation.

5.2 JPR is not responsible for driver performance. This includes the performance of other drivers forming part of the driver’s team even where JPR has made arrangements for the hirer/driver to participate in a team with other drivers. Before entering into this agreement on this basis, the hirer/driver should ensure that they are satisfied with the racing experience of other team members.

5.3 JPR will have no liability to the hirer/driver for any loss of profit, loss of business, loss of sponsorship, business interruption, loss of business opportunity, or loss of sponsorship opportunity.

5.4 JPR does not provide any insurance cover to the hirer/driver.

6. YOUR CONSENT TO PARTICIPATE IN A DANGEROUS SPORT

6.1 Motor racing is a dangerous sport. All drivers must wear the safety equipment as per the Motorsport UK blue book. In addition to this, all drivers must use a full face helmet, as per the Fun Cup regulations. JPR also recommend the use of fire proof under wear. The hirer/driver must sign the declaration below.
